Depending on the circumstance under which you access the unemployment benefit, the date of the event giving rise to entitlement to it will be as follows:

• Unemployment benefit due to exhaustion of the contributory benefit:
  Date on which the contributory unemployment benefit is exhausted.
• Unemployment benefit due to proving insufficient contributions to access the contributory benefit:
  Date of the last /HomeSepe/en/prestaciones-desempleo/situacion-legal-desempleo.htmllegal situation of unemployment prior to the application for the benefit.
• Unemployment benefit for workers aged over 52:
  If you access it due to having exhausted, on 1 November 2024 or later, a contributory unemployment benefit: the date of the qualifying event is the date on which the contributory benefit is exhausted.
  
  If you access the benefit having contributed for at least ninety days, the date of the qualifying event is that of the last legal situation of unemployment prior to the application for the benefit for workers aged over 52.
  
  If, on the date on which you are entitled to resume any benefit, you meet all the requirements to access the benefit for workers aged over 52, the date of resumption of the benefit shall be considered the date of the qualifying event.
  
  If, when you exhausted the contributory benefit or when you were in a legal situation of unemployment and had contributed at least 90 days, you met all the requirements to access the benefit for workers aged over 52, but had not yet reached the age of 52 and reach it subsequently, the date of the qualifying event shall be the date on which that age is reached.
  
  You may apply for this benefit provided that you meet the following conditions:
  > On the date of submission of the application, you meet the requirement of /HomeSepe/en/prestaciones-desempleo/carencia-de-rentas.htmllack of income.
  > You have remained registered as a job seeker.

• Unemployment benefit for returning emigrants.
  The date of the qualifying event shall be the date of return to Spain in order to establish permanent residence.

• Unemployment benefit for victims of gender-based violence, sexual violence (including trafficking in human beings for the purpose of sexual exploitation) or violence exercised by parents or children.
  The date of the qualifying event is the date on which the competent authority issues the corresponding report certifying that you are a victim of gender-based or sexual violence, the date on which the Public Prosecutor’s Office issues its report, or the date of notification of the corresponding court judgment or judicial decision.

If more than six months have elapsed between the date of issue of the documents certifying the different types of violence and the date of application for the benefit, the date of the qualifying event for the benefit shall be the date of application.
