Remember that if your company is in an ERTE, whether due to force majeure or economic, technical, organizational, or production (ETOP) reasons caused by the effects of the February floods, you should not apply for the benefit individually; instead, your company will apply on your behalf and with your authorization through the submission of a collective application.

Once your ERTE floods benefit has been approved, SEPE will send an SMS to the mobile phone number indicated in the collective application, informing you whether the benefit has been granted with or without children in your care, based on the data we have at SEPE. The SMS will also provide information on how to access this website to explain how to update that family information if necessary.

Your company will also be responsible for informing SEPE of your return to activity (termination of the benefit) when it occurs, as well as any changes to your working hours or other situations (vacation, maternity/paternity leave, temporary disability, etc.). 

If you are a wage-earning worker included in the Special System for Agricultural Wage Earners who resides or has your workplace in any of the municipalities affected by the floods or adverse weather events, you will be entitled to receive the agricultural subsidy or the agricultural income, provided that you meet the requirements for each benefit and have covered a minimum of five actual working days contributed in the twelve calendar months immediately preceding the unemployment situation.

If you are a domestic worker and your activity has been interrupted or reduced due to floods and other adverse weather events, you will be entitled to unemployment benefits under the same conditions as workers included in an ERTE.

You can apply for your contributory benefit even if you do not have the minimum contribution period. Your contributions will not be used up, and the time you receive the benefit due to the floods will also be considered as contributed toward future benefits.

You must submit an individual application (it is not handled through a collective application as with an ERTE) within a period of 15 business days starting from March 2, 2026, if your activity has already been affected, or from the moment it becomes affected. You must accompany your application with a responsible declaration from your employer or employers.

You can submit your application: 

• In person, by prior appointment, at a SEPE benefit office, providing a paper copy of a responsible declaration for each situation of total or partial inactivity (for each job).
• Through the benefit application on the SEPE electronic office, for which you would need a digital certificate or cl@ve user. You will attach a responsible declaration for each situation of total or partial inactivity as an annex to the application.
• By submitting a pre-application form, which you will also find on the SEPE electronic office. You will attach a responsible declaration for each situation of total or partial inactivity as an annex to the pre-application form.

If you submit your application electronically (electronic application or pre-application), it is advisable to indicate in the observations field that you are applying for the benefit due to the February 2026 floods and that you are a domestic worker. Remember to attach the responsible declaration for each job from which you are temporarily ceasing activity.

Do not forget to inform us when you return to work in each contract or if your working hours are increased beyond what was indicated in the responsible declaration, as your benefit would need to be recalculated. And, when you return to your normal activity, let us know so that we can terminate the benefit and avoid having to regularize and claim back amounts later. You can do this through the pre-application, using the "Termination of benefit or communication of travel abroad" procedure, indicating in the observations field whatever you consider relevant (increase in activity by X hours since X date, end of inactivity due to floods since X date, etc.).

It is important that you check if we have recognized your benefit with the correct family information. You could be entitled to a higher benefit amount, but also a lower one, and a reconciliation would be required later. 

How does the information about children you provide affect your benefit?

The minimum and maximum caps established by the Social Security Law for the amount of the contributory benefit apply to the ERTE-inundaciones benefit. Therefore, if your employment relationship is at 100% of the working day (full-time contract), keep in mind that:

• The minimum benefit you could receive is €560.00 (80% IPREM) if you have no dependent children.
• That minimum would rise to €749.00 (107% IPREM) if you have any dependent children.
• Regarding the maximums, you will receive up to €1,225.00 (175% IPREM) if you have no dependent children.
• With one dependent child, that maximum rises to €1,400 (200% IPREM).
• With two or more children, the maximum is €1,575.00 (225% IPREM). 

1) What happens if your contract is part-time?

Those maximum and minimum caps will be reduced based on the percentage of the working day. If your contract with the company in ERTE-inundaciones is, for example, at 75% of the working day, the minimum and maximum caps will be 75% of the stated amounts—€918.75 as the maximum cap without children, instead of €1,225. 

2) How to know if you are at the minimum or maximum? 

You know that the amount of the ERTE-inundaciones benefit is 70% of your base reguladora throughout the time you receive it. We calculate that base reguladora from your contributions over the last 180 days (or based on your time at the company in ERTE if it is less than 180 days). If 70% of that monthly base reguladora falls below the minimum caps, your benefit amount will increase to the corresponding minimum, with or without children and according to the percentage of the part-time contract. If it exceeds the maximum caps, what you receive will also depend on dependent children and the partial nature of the contract.

These amounts are gross and will have the corresponding Social Security contribution deducted.

3) How to know if you have dependent children? If they live with you, are they considered dependent?
What determines that children are considered dependent is:

• that they depend on you economically (they live with you or you pay child support); 
• that they are under 26 years old, or older with a degree of disability equal to or greater than 33%, or minors in foster care;
• that they do not have their own income exceeding the professional minimum wage (SMI), i.e., less than €1,221. 

If your benefit amount can be increased (from a base reguladora of €58.34/day or €1,750.20/month for the maximum caps, and below €26.67/day or €800/month for the minimum caps), you can update your family information.

If we indicate a number of children that is incorrect because they are no longer dependent on you, you must notify us so that you do not receive a higher benefit than what is due, thus avoiding us reclaiming unduly perceived amounts.

The update of family information can be done through:

• the data update service on the sede electrónica, which requires identification via digital certificate, electronic DNI, or a username and password provided by the Cl@ve firma platform.
• the submission of a written request via the electronic register sent to the corresponding SEPE provincial directorate or delivered to a registry assistance office (OAMR),

Attach the supporting documentation to your request for the inclusion of dependent children (family book or civil registry certification of birth or family, regulatory agreement, etc.). You must indicate the full name, date of birth, and income of the children to be included in your benefit. With this, we will reconcile, if applicable, the amounts paid to date and modify the amount to be received.
 

Were you already receiving another benefit while working at the company where you are now in an ERTE?

If you were combining the work affected by the ERTE for floods with an unemployment benefit or receiving the employment support supplement and you have been included in the collective application, the SEPE will have approved your ERTE benefit while suspending the other one. If you wish to opt for the previous benefit, you can do so by telephone by calling 060.

We remind you that the ERTE benefit does not consume contributions or days from your other benefit and that, once it ends, you can return to receiving the previous benefit from where you left off, upon request. Additionally, the time you receive the ERTE benefit will be considered as contributed for the purposes of a future benefit.
